NORMA & EDUARDO B. DIAGO vs. DBP.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this court dated JUL 19, 1999.
G.R. No. 138347 (Norma B. Diago and Eduardo B. Diago vs. Development Bank of the Philippines.)
The urgent motions of petitioners for second and third extension of time totaling thirty (30) days from 27 May 1999 within which to file petition for review on certiorari are DENIED with FINALITY for petitioners' failure to submit an affidavit of service of copies of the motions on the Development Bank of the Philippines and on the Court of Appeals as well as the postal registry receipts as proof of mailing of copies of the motion to respondents pursuant to Section 2, Rule 45 of the 1997 Rules of Civil Procedure, and for lack of compelling reason to warrant the grant of further extension, petitioners' first motion for extension of time to file petition having been denied in the resolution of 26 May 1999.
Very truly yours,
TOMASITA M. DRIS
