Quoted hereunder, for your information, is a resolution of this court dated JUL 5, 1999.

G.R. No. 138524 (Samleon S. Pimentel, Sr. vs. The Municipal Trial Court of San Jose, Occidental Mindoro, et al.)

The motion of petitioner for extension of time to file petition for certiorari and prohibition with prayer for preliminary injunction and/or restraining order is DENIED for failure to serve copy of the motion on respondent and on the Municipal Trial Court of San Jose, Occidental Mindoro in accordance with Section 4, Rule 13 of the 1997 Rules of Civil Procedure, as amended.

Accordingly, petitioner's urgent motion dated 20 May 1999 for the issuance of a temporary restraining order is DENIED, and his manifestation dated 2 June 1999 attaching a copy of the commitment order and praying for the immediate issuance of a temporary restraining order is NOTED.
