Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JUL 12, 1999.
G.R. No. 138730 (Capt. Edgardo S. Sanicas vs. United Salvage and Towage, Inc., et al.)
The motion of the petitioner for extension f fifteen (15) days from 9 June 1999 within which to file petition for certiorari is GRANTED.
In accordance with Rule 65 in relation to Rule 46, Rule 56 and other pertinent provisions of the 1997 Rules of Civil Procedure, as amended, governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitions which are accompanied by or which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court RESOLVES to DISMISS the petition for certiorari for failure to:
(a) submit proof of alleged service of copies of the petition on private respondent and on the National Labor Relations Commission in accordance with Section 13, Rule 13 in relation to Section 3, Rule 46, and Section 2, Rule 56 of the Rules; and
(b) timely submit with the petition the duplicate original or certified true copy of the questioned decision of the National Labor Relations Commission dated 30 April 1999 in accordance with Section 1, Rule 65, and Section 3, Rule 46 in relation to Section 2, Rule 56.
Accordingly, the urgent ex-parte motion/manifestation of petitioner's counsel to correct the name and surname of petitioner and to admit attached duplicate original/certified copy of the questioned decision of the National Labor Relations Commission is NOTED WITHOUT ACTION, and aforesaid duplicate original (certified copy) of said decision is NOTED.
