Quoted hereunder, for your information, is a resolution of this court dated JUL 26, 1999
G.R. 139024 (Juan Jamora, Jr. Ent. Incorporated, represented by its President and General Manager Juan Jose Jamora vs. Sangguniang Panglungsod of Iloilo, et al.)
The motion of petitioner for extension of thirty (30) days from 16 June 1999 within which to file petition for review on certiorari is DENIED for petitioner's failure to serve copy of the motion on the Regional Trial Court and for lack of a written explanation why the filing with the Court was not done personally, as a consequence of which the motion is deemed as not filed in accordance with Sections 4 and 11, Rule 13 in relation to Sections 2 and 3, Rule 45 of the 1997 Rules of Civil Procedure, as amended.
Accordingly, the Court RESOLVES to DENY the petition for review on certiorari for petitioner's failure to take the appeal within the reglementary period of fifteen (15) days in accordance with Sections 2, Rule 45 in relation to Section 5(a), Rule 56 of the 1997 Rules of Civil Procedure, as amended.
