Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JUL 20, 1999 .
A.M No. 99-2-79-RTC(Re: Request of Judge Irma Zita Masamayor RTC-Br. 52, Talibon, Bohol for Extension of Time to Decide Crim. Case No. 96-251.)
In its resolution of March 16, 1999, the Court granted Judge Irma Zita Masamayor of the Regional Trial Court, Branch 52, Talibon, Bohol, a 45-day extension of time from January 2, 1999 to February 16, 1999 within which to decide Criminal Case No. 96-251, entitled People of the Philippines. v. Gil Sajuna, and ordered her to thereafter furnish the Office of the Court Administrator with a copy of her decision.
In her letter, dated March 31, 1999, however, Judge Masamayor requested a second extension of 30 days from April 4, 1999 to May 4, 1999 to decide the criminal case. This was followed by another letter, dated May 6, 1999, in which she informed the Court that the decision in the said case was promulgated on May 4, 1999 and that a copy of the decision in the case is being submitted in compliance with the Court's resolution of March 16, 1999.
It appearing that the request for a second extension of time was made after the expiration of the first extension of 45 days on February 16, 1999, the Court RESOLVED to REQUIRE Judge Irma Zita V. Masamayor of the RTC, Branch 52, Talibon, Bohol, within ten (10) days from notice, to show cause why no disciplinary action should be taken against her for making her request for a second extension of time after the first extension granted to her had expired.
