Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated MAR 8, 1999.
G.R. No. 121327 (Cecilio delos Santos, et al. vs. National Labor Relations Commission, et al.)
Considering that private respondents Raul Ruiz, owner of private respondent Top Flite manpower Agency has not up to this very late date filed a memorandum in this case as required in the resolution of 2 December 1996 despite the resolution of 28 April 1997 and 26 November 1997 requiring private respondents to explain why no disciplinary action should be taken against them for such failure and to submit their memorandum as well as the resolution of 13 July 1998 and 9 November 1998 imposing upon each of them a fine of P1,000.00 and increasing such fine P2,000.00, and it appearing, as certified to by this Court's Cashier that private respondents have not also paid the increased fine, the Court DECLARES private respondent Raul Ruiz GUILTY of contempt of Court under Rule 71, Sec. 3[b] of the Rules of Court, and ORDERS his IMPRISONMENT until he complies with the Court's directive and submits the required memorandum. The Division Clerk of Court is directed to ISSUE the corresponding Order of Arrest and Commitment for immediate service by the National Bureau of Investigation.
