Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 3, 1999.

G.R. No. 130352 (Rozelia P. Diaz-Duarte vs. Spouses Ben and Ethyl Ong).

The appearance of Atty. Alberto O. Regino, Jr. of Saludo Agpalo Fernandez and Aquino as collaborating counsel for respondents, with request to be furnished with copies of Court processes in this case at the 2nd floor, PNB Financial Center, Roxas Blvd., Pasay City, is NOTED and GRANTED.

Acting on the other pleadings filed in this case, the Court RESOLVES: (a) to DENY the motion of respondents for leave to file and admit their second motion for reconsideration of the decision of November 3, 1998 and of the resolution of January 13, 1999 denying their motion for reconsideration of the said decision of November 3, 1998 pursuant to Section 2, Rule 52, in relation to Section 4, Rule 56 of the 1997 Rules of Civil Procedure as amended; and (b) NOTE WITHOUT ACTION [1] the aforesaid second motion for reconsideration dated February 16, 1999; [2] the motion of respondents to file reply to petitioner's opposition to their motion for reconsideration of the aforesaid decision of November 3, 1998; [3] the aforesaid reply of respondents dated January 10, 1999; and [4] petitioner's rejoinder to the said reply dated January 25, 1999, respondents' first motion for reconsideration of the aforesaid decision of November 3, 1998 having been denied with finality in the aforementioned resolution of January 13, 1999 on the ground that the basic issues raised therein have previously been duly considered and passed upon by the Court in the aforesaid decision and no substantial argument was adduced to warrant the reconsideration sought.
