Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 1, 1999.

G.R. No. 136024 (Molave Dev't Corp., et al. vs. Covidono Realty, Inc., et al.)

From the decision of the Housing and Land Use Regulatory Board dated July 9, 1992, and the consequent Resolution dated October 10, 1994, denying the Motion for Reconsideration, Molave Development Corporation appealed to the Office of the President.

On October 1, 1997, the Office of the President affirmed the decision with modification. The first and second motions for reconsideration were denied on May 25, 1998 and October 3, 1998, respectively.

Thus, on December 4, 1998, Molave Development Corporation filed a Petition with this Court assailing the decision rendered by the Office of the President and the resolutions denying their motions for reconsideration.

Acting upon the petition, the Court issued a resolution on January 20, 1999 denying said petition for non-compliance of the 1997 Rules of Civil Procedure particularly for petitioner's failure to state the material dates.

Consequently, petitioner filed a motion praying for the reconsideration of the aforesaid resolution and to admit its Amended Petition.

We deny the motion. Aside from the fact that we find no compelling reasons to warrant a reconsideration of our Resolution dated January 20, 1999, the instant petition must fail on the ground that petitioner has taken a wrong mode of appeal from the decision of the Office of the President. Pursuant to Rule 43 of the 1997 Rules on Civil Procedure, decisions of quasi-judicial bodies including the Office of the President are appealable to the Court of Appeals.

IN VIEW OF THE FOREGOING, the Court Resolved to DENY the motion. This denial is final.
