RE: PROPOSED RULES ON MANDATORY CONTINUING LEGAL EDUCATION.

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAY 18 1999.

B.M. No. 850 (Re: Proposed Rules on Mandatory Continuing Legal Education for Active Members of the Integrated Bar of the Philippines.)

The Court Resolved to NOTE the (a) letter of National President Jose Aguila Grapilon to the Chief Justice, dated 30 March 1999, submitting the Proposed Rules on Minimum Continuing Legal Education for Active Members of the Integrated Bar of the Philippines, (b) compliance, dated 30 March 1999, of the IBP President Jose A. Grapilon, and (c) aforesaid Revised Rules Proposed on Minimum Continuing Legal Education for Active Members of the IBP.

The Court further Resolved to:

(1) APPROVE the report and recommendation dated 11 May 1999 of Associate Justice Jose C. Vitug.

(2) REFER to the Integrated Bar of the Philippines ("IBP") for its comment and recommendation the letter, dated 15 March 1999, of the Philippine Shari'a Court Trial Judges League addressed to the Chief Justice requesting special membership of the members of the Shari'a Bar (Numbering about 240 members);

(3) require the College of Law of the Baguio Colleges Foundation to SUBMIT on the mechanics for its proposed shift from two-semester to the trimester calendar, as well as the outline of the course study, and any implication thereof on the Rules of Court;

(4) DENY the petition for the abolition of the compulsory refresher course prescribed in Section 16, Rule 138, of the Rules of Court; and

(5) APPROVE in principle the Proposal for Minimum Continuing Legal Education, as revised (incorporating the suggestions of PHILJA), and thereupon to refer the matter back to the Integrated bar of the Philippines for further feasibility study and establishment of pilot areas to test the efficacy of the Minimum Continuing Legal Education and the features of the proposed agreements with possible providers, with a request that IBP promptly submits its report and findings so that a definite approval can forthwith be considered by the Court.
