PEOPLE vs. ROBERTO PALABRICA

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated NOV 16 1999.
G.R. No. 129285(People of the Philippines vs. Roberto Palabrica.)
For his failure to file the
appellant's brief, Atty. Vic Agravante was fined One Thousand Pesos (P1,000.00)
and ordered to file the said brief on March 23, 1999. He moved for a
reconsideration but his motion was denied by the Court on July 6, 1999 for lack
of merit. The fine was increased to Two Thousand Pesos (P2,000.00) in
the resolution of June 22, 1999 upon the certification of the cashier of the
Court that he had not paid the fine of P1,000.00.
On September 21, 1999, Atty.
Agravante paid the Court P1,000.00. As the amount of fine imposed on him
had been increased to P2,000.00, it is obvious that Atty. Agravante's
payment only partly satisfied the fine for which he is liable.
Considering the foregoing, the
Court RESOLVED to NOTE the payment made by Atty. Vic Agravante and to REITERATE
the resolution of June 22, 1999 increasing the fine on him to P2,000.00.
Atty. Agravante is given ten (10) days from notice within which to pay the
balance of P1,000.00 otherwise he will be ordered arrested.
