Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated OCT 26, 1999.

G.R. No. 133648(The People of the Philippines v. Marlene Castro y Havoc.)

Considering the (a) letter, dated October 5, 1998, of Clerk of Court Esperanza G. Arceo of the Regional Trial Court, Branch 163, Pasig City, informing the Court that the transcript of stenographic notes taken on July 17, 1996, July 30, 1996, and April 8, 1997 by stenographer Nelia T. Balia cannot be transmitted to this Court on the ground that stenographer Balia has ceased to be connected with said court and her whereabouts are unknown, and the (2) indorsement of Undersecretary Ramon J. Liwag, of the Department of Justice, concerning the request of Director Pedro G. Sistoza of the Bureau of Corrections for authority to have accused-appellant Marlene Castro y Havoc examined at the National Center for Mental Health for possible confinement therein, the Court RESOLVED:

(1) to require Clerk of Court Esperanza G. Arceo to inform the Court within ten (10) days from notice whether the notes taken at the aforesaid hearings by stenographer Balia have been preserved and, if so, whether they can be transcribed by another stenographer; and

(2) to require the Solicitor General to comment within ten (10) days from notice on the request of Director Sistoza for authority to have accused-appellant examined at the National Center for Mental Health for possible confinement.

The Clerk of Court is directed to furnish forthwith the Solicitor General a copy of the letter, dated August 6, 1999, of Director Sistoza.

Bellosillo, Puno, Quisurnbing, and Ynares-Santiago, JJ., are abroad on official business.
