[ G.R. No. 132195. September 27, 1999]
JUANITA DAMASCO vs. CA, et al.
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated SEPT 27 1999.
G.R. No. 132195 (Juanita Damasco vs. Court of Appeals, et al.)
Considering the allegations, issues and arguments adduced in the petition for review on certiorari, comment thereon of respondent and reply of petitioner to said comment, the Court RESOLVES to DENY the petition, the issues raised being essentially factual and there being no showing of extra-ordinary circumstance justifying a departure from the established doctrine that findings of facts of the Court of Appeals are well-nigh conclusive on this Court and will not be reviewed or disturbed on appeal, or that said court had committed any reversible error in the questioned judgment or that the same is tainted with grave abuse of discretion as to warrant the exercise by this Court of its discretionary appellate jurisdiction in this.
Very truly yours,
(Sgd.) TOMASITA B. MAGAY-DRIS
Clerk of Court
