Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated SEPT 29, 1999.
G.R. No. 139756 (Spouses Rolando Banogan Tablang and Evelyn C. Tablang vs. Lilia C. Espa�ol, et al.)
In accordance with Rule 65 in relation to Rule 46, Rule 56 and other pertinent provisions of the 1997 Rules of Civil Procedure, as amended, governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitions which are accompanied by or comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court RESOLVES to DISMISS the petition for certiorari for petitioners' failure to:
a) serve copies of the petition on respondents and on the Regional Trial Court in accordance with Section 4, Rule 13 and Section 3, Rule 46 in relation to Section 2, Rule 56;
b) attach a certification against forum shopping duly signed and executed by petitioners themselves in accordance with Section 5, Rule 7, and Section 3, Rule 46 in relation to Section 2, Rule 56, and
c) submit a clearly legible duplicate original certified true copy of the assailed order of the Regional Trial Court of Alaminos, Pangasinan, Branch 55 in accordance with Section 3, Rule 46 in relation to Section 2, Rule 56.
Moreover, petitioners failed to adduce any compelling reason to warrant their disregard of judicial hierarchy in accordance with Rule 65, Section 4 f the 1997 Rules of Civil Procedure and for this Court to assume jurisdiction over the case in the first instance.
