Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated Feb 9, 2000.

G.R. No. 140744 (Luis Q. Uranza, Jr. vs. Court of Appeals and Hon. Antonio M. Eugenio, Jr. in his capacity as Presiding Judge of Branch 34 of the RTC of Calamba, Laguna.)

Petitioner, in his motion for reconsideration of the 13th December 1999 Resolution of the Court dismissing the petition, submits that the Order and Resolution subject of the petition for certiorari, do not dispose of the main case with finality and that, therefore, an appeal would not have been an available remedy. The petition, nevertheless, would still have to be dismissed for having been filed out of time. Petitioner received a copy of the assailed decision of the Court of Appeals on 25 June 1999. He filed his motion for reconsideration on 07 July 1999, thereby allowing twelve (12) days to lapse. Pursuant to Rule 65 of the 1997 Rules of Civil Procedure, petitioner had only the remaining forty-eight (48) days from receipt, on 08 October 1999, of the denial of his motion for reconsideration within which to file the petition for certiorari. The due date for filing the petition would have been on 25 November 1999 but the petition, unfortunately, was filed only on 02 December 1999, or late by seven days.

Accordingly, the motion for reconsideration is DENIED. This denial is final.
