[ G.R. No. 140932. January 18, 2000]
YAHCOB LAIA, et al. vs. COMELEC, et al.
EN BANC
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 18 2000.
G.R. No. 140932 (Yahcob Laia, Amman Taddah, Alonto Taug, Ismael Sakirulla, Galib Mutalib, et al. vs. Commission on Elections, Hassan Idum, Norma Ahamad, Eking Dawaem, et al.)
In accordance with Rule 65 and other related provisions of the 1997 Rules of Civil Procedure governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitions which are accompanied by or which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court Resolved to DISMISS the instant special civil action for prohibition for non-compliance therewith, particularly for failure to accompany petition with a clearly legible duplicate original, or certified true copy of the judgment/final order/resolution certified by the Clerk of Court of the court a quo in violation of Section 1, Rule 65 and Section 3, Rule 46 in relation to Section 2, Rule 56.
In any event, the petition would still be dismissed for failure of the petitioners to sufficiently show that public respondent acted with grave abuse of discretion in rendering the questioned decision.
Further, the Urgent Motion Ex-Parte Reiterating the Prayer for the Issuance of a Temporary Restraining Order dated 27 December 1999 filed by counsel for petitioners, is DENIED, for lack of merit. Pardo, J., no part.
Very truly yours,
LUZVIMINDA PUNO
