Quoted hereunder, for your information, is a resolution of this Court dated JUL 12, 2000.

G.R. No. 141603 (Filipro, Inc., vs. Vilextrade Manufacturing, Inc.)

On 08 February 2000, Filipro, Inc. (Petitioner), filed with this Court an Urgent Motion for Time to File Petition for Review from the decision, dated 18 January 2000, of the Court of Appeals in "Filipro, Inc., vs. Villextrade Manufacturing, Inc.," docketed CA-G. R. CV No. 47932. The Court ruled favorably on the motion. Subsequently, the Petition for review was filed.

Acting on the Petition, the Court without giving due course thereto, directed Vilextrade Manufacturing, Inc. (respondent) to file its Comment within ten (10) days from receipt of the resolution.

In lieu of comment, respondent filed its Manifestations with Motion, dated 17 May 2000, asserting that the Court of Appeals is yet to rule on its Motion for Partial Reconsideration of the 18 January 2000 decision. A copy of its Motion for Reconsideration duly received by the Court of Appeals on 09 February 2000 and the petitioner's Comment thereto, dated 01 March 2000, were attached to the Manifestation.

In view of the foregoing, the Petition for Review is DISMISSED for having been pre-maturely filed.

The respondent's Motion for Extension of Time to File Comment is noted.
