Quoted hereunder, for your information, is a resolution of this Court dated JUN 14 2000.
G.R. No. 119652 (Ventura O. Ducat, vs. The Court of Appeals, Honorable Arsenio J. Magpale, in his capacity as Presiding Judge of the Regional Trial Court of Makati, Branch 57, and Papa Securities Corporation.)
A.M. No. P-00-1358 (Ventura O. Ducat, vs. Sheriff Rolando D. Carpio.)
This resolves a Motion for Reconsideration of the Decision of this Court, dated January 20, 2000, denying movant's petition for review on certiorari, and affirming the Decision of the Court of Appeals in CA-G.R. SP No. 35526. This Court found the petitioner estopped from questioning the order of the trial court of October 17, 1994, and upheld the validity of subject auction sale and the issuance of the corresponding Certificate of Sale. The Court also dismissed Administrative Complaint No. P-00-1358 against Sheriff Rolando Carpio of Branch 57 of the Regional Trial Court of Makati for want of merit.
Evidently, the motion poses nothing new. Movant merely reiterates the thrust of the petition. The points raised and arguments advanced in support of the motion have been passed upon, and after giving the same a second hard look, the Court discerns no sustainable basis for disturbing the judgment sought to be reconsidered.
WHEREFORE, petitioner's Motion for Reconsideration is hereby DENIED for want of merit.
