FIRST DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 14 2000.

G.R. No. 133547 (Heirs of Antonio Pael et al. vs. CA et al.)

Considering the Motion for Reconsideration filed by petitioners Heirs of Pael and Maria Destura and intervenor Luis M. Menor, the Court Resolved to require COMMENT thereon within fifteen (15) days from receipt hereof.

In view of the allegations that in several decisions of this Court, the University of the Philippines was declared the true, absolute, lawful and registered owner of parcels of land situated in Diliman, Quezon City, and that the properties subject of the Decision of this Court in the above-entitled cases of which private respondents Chin and Mallari were declared the true and absolute owners are within the UP Campus, the Court Resolved:

1. to DIRECT the Clerk of Court of this Division to FURNISH the office of the President, University of the Philippines, with copies of the Motions for Reconsideration filed by petitioners Heirs of Pael, Maria Destura and intervenor LuisMenor; and

2. to likewise require the University of the Philippines, through the Office of the Solicitor General, to COMMENT on the aforesaid Motions for Reconsiderations within ten (10) days from receipt thereof.

The Court further Resolved to NOTE the following:

(a) MANIFESTATION dated March 16, 2000 of petitioners Roberto Pael & Jose Pael themselves in G.R. No. 133547 that they have engaged the legal services of Atty. Mary Catherine Hilario to prepare and file the motion for reconsideration;

(b) ENTRY OF APPEARANCE of Atty. Mary Catherine P. Hilario, 4 th Floor, Dominga Bldg., Chino Roces Ave. corner Dela Rosa St., Makati City as counsel for petitioner in G.R. No. 133547;

(c) MOTION for leave to fine the therein incorporated comment on petitioner's motion for reconsideration, by respondents Jorge Chin & Renato Mallari themselves;

(d) COUNTER-MANIFESTATION dated March 23, 2000 of Pa�o, Gonzales, Relova & Associates, counsel for petitioners Roberto Pael & Jose Pael, with prayer that the manifestation dated March 16, 2000 of said petitioners be denied, stricken off from the records for being unauthorized;

(e) LETTER dated March 28, 2000 of Atty. Antonio A. Fernandez, counsel for intervenor Luis M. Menor informing the court that on March 27, 2000 he mailed intervenor's Motion for reconsideration of the decision of this case;

(f) MOTION TO ADMIT therein attached Sinumpaang Salaysay of Roberto Pael and Jose Pael with prayer that the motion for reconsideration by Pa�o, Gonzales, Relova and Associates be disregarded instead the motion for reconsideration filed on March 22, 2000 with the authority of the petitioners be given due course, by Mary Catherine P. Hilario, counsel for petitioners Pael;

(g) FIRST INDORSEMENT dated May 10, 2000 from the DOJ referring to this Court for action the letter dated March 29, 2000 of Mr. Amelito B. Amores, with copy of "Motion For Reconsideration with Motion for Verification" and technical factual findings;

(h) MOTION FOR LEAVE OF COURT TO FILE REPLY TO COUNTER-MANIFESTATION, by petitioners in G.R. No. 133547; and

(i) Aforesaid REPLY to counter-manifestation.

The Court DENIED the Manifestation and Motion Before the Honorable Supreme Court En Banc, by petitioners in G.R. No. 133843 praying that the reliefs prayed for therein including the voluntary inhibition and/or disqualification of Hon. Madame Justice Consuelo Ynares-Santiago from further taking cognizance of the above cases be granted and EXPUNGED from the records the First Motion For Reconsideration With Motion for Verification of the decision dated February 10, 2000 by Armelito B. Amores, Sr. Geodetic Engineer for petitioners in G.R. No. 133547, the movant therein not being a party to this case.
