Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 14 2000.

G.R. No. 141999 (R Transport Corporation vs. Hon. Court of Appeals, Special Eight Division, Hon. Benjamin F. Martinez, et al.)

Petitioner assails the decision of the Court of Appeals affirming the decision of both the Municipal Circuit Court and the Regional Trial Court.

Petitioner is the owner of an MMTC Bus which collided and bumped private respondent's Mercedes Benz, causing damage the left front portion of the car and prompting the latter to file an action for damages before the Municipal Trial Court.

The trial court decided in favor of private respondent and upon appeal, the regional trial court affirmed.

Upon petition, the Court of Appeals affirmed the award of P30,755.00 as actual damages, but deleted the award of moral and exemplary damages and instead awarded attorney's fees to private respondent in the amount of P5,000.00.

There are no sufficient allegations which would warrant the invocation of this Court's intervention (Lasco vs. United Nations Revolving Funds for National Resources Exploration, 241 SCRA 681 [1995]). Moreover, the only issue presented in the present controversy is the ownership of the Mercedes Benz which the trial court found to be private respondent's, a factual finding which the Court is not inclined to disturb.

WHEREFORE, petition is denied due course.
