Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated NOV 20 2000.

G.R. No. 107132 (Maxima Hemedes vs. Court of Appeals, Dominium Realty and Construction Corporation, Enrique D. Hemedes, and R & B Insurance Corporation.)

G.R. No. 108472 (R & B Insurance Corporation vs. Court of Appeals, Dominium Realty and Construction Corporation, Enrique D. Hemedes and Maxima Hemedes.)

On November 11, 1999, Dominium Realty and Construction Corporation, private respondent in the above-entitled case, filed a Motion for Reconsideration of this Court's Decision dated October 8, 1999. R & B Insurance Corporation, as petitioner in G.R. No. 108472, filed its Comment praying for the affirmance of the decision and the denial of respondent's Motion for Reconsideration. No comment thereto was filed by the other parties.

Thereafter, private respondent Dominium Realty and Construction Corporation filed a "Withdrawal of Motion for Reconsideration" alleging that it had agreed with R & B Insurance Corporation to settle the dispute between them. Private respondent prays that the Motion for Reconsideration it filed earlier "be deemed withdrawn and that entry of judgment" be issued. It is noted that no other party filed a motion for reconsideration of the said decision. Accordingly, the decision has become final and executory.

WHEREFORE, as prayed for, the Motion for Reconsideration filed by private respondent Dominium Realty and Construction Corporation is hereby considered WITHDRAWN. Let entry of judgment issue in due course.
