Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated OCT 16 2000.
G.R. No. 137492 (People of the Philippines vs. Benjamin Sagaysay y Medula.)
In the Court's Resolution dated June 14, 2000, Atty. Joel Baquiran, counsel for accused-appellant, was required to show cause why he should not be disciplinary dealt with for his failure to file the appellant's brief despite notice thereof.
In the Compliance dated August 3, 2000, counsel Baquiran explained that the appellant's brief was not filed "because of the verbal instruction of his client to withdraw the appeal" and that there was never any intention to delay the proceeding. He therefore prays that the appeal of accused-appellant Sagaysay be withdrawn. The Compliance was signed by counsel with the conformity and signature of accused-appellant himself.
WHEREFORE, PREMISES CONSIDERED, the appeal of accused-appellant Benjamin Sagaysay is hereby considered WITHDRAWN.
