Quoted hereunder, for your information, is a resolution of this Court dated OCT 9 2000.

A.M. No. OCA 96-128-P (Annabelle T Gutierrez v. Ma. Refugio {Nenette} C. Pilapil, Social Welfare Officer II, R TC, Branch 38, Manila.)

For consideration of the Court is the order, dated November 26, 1998, of Judge Maximo A. Savellano, Jr., then Executive Judge of the Regional Trial Court of Manila, dismissing this case with prejudice.

This case had earlier been referred to Judge Savellano for investigation, report, and recommendation. However, it appears that Judge Savellano dismissed the case upon the joint motion of the parties, assisted by their respective counsels, on the ground that the case arose out of a misunderstanding. The incumbent Executive Judge of Manila, Judge Mario Guari�a III, subsequently forwarded the records of the case to the Office of Court Administrator.

Considering the foregoing, the Court RESOLVED to CONFIRM and APPROVE the order, dated November 26, 1998, of Judge Maximo A. Savellano, Jr. and to consider this case CLOSED and TERMINATED.
