[ A.M. OCA IPI No. 98-610-RTJ. October 4, 2000]
CRESENTE G. VILLAHERMOSA II, vs. JUDGE ADOLFO F. ALAGAR
THIRD DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated OCT 4 2000.
A.M. OCA IPI Nos. 98-610-RTJ and 99-675-RTJ (Cresente G. Villahermosa II, vs. Judge Adolfo F. Alagar, Regional Trial Court, San Fernando City La Union, Branch 66.)
This resolves complainant Cresente Villahermosa II's Motion seeking reconsideration of the Resolution of March 6, 2000. The assailed Resolution adopted the recommendation of Associate Justice Portia Alino-Hormachuelos of the Court of Appeals to dismiss the complaint for lack of merit. Complainant insists that respondent judge should be dismissed from the judiciary for grave abuse of discretion, ignorance of the law and unbecoming conduct.
Evidently, the motion poses nothing new. The points raised and arguments advanced are a reiteration of the issues which have been discussed in the report of Justice Alino-Hormachuelos. And after giving the said report a second hard look, the Court discerns no sustainable basis for disturbing the same.
WHEREFORE, complainant's motion for reconsideration under consideration is DENIED.
SO ORDERED.
Very truly yours,
(Sgd.) JULIETA Y. CARREON
Clerk of Court
