Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 26 2000.

G.R. No. 134167 (Nasser Immam vs. Commission on Elections, et al.)

For resolution is petitioner's "Motion for Leave of Court to File the Herein Incorporated Second Motion for Reconsideration and/or to Modify the Decision due to Supervening Events with Prayer to Maintain the Status Quo," filed on August 31, 2000, wherein he alleges that on August 28, 2000, he filed a Motion for Leave to file Reply to Public Respondent's Comment. Subsequently, he received a copy of our Resolution dated August 22, 2000, denying with finality his Motion for Reconsideration of our Decision dated January 20, 2000. Hence, petitioner prays that said August 22, 2000 Resolution be recalled inasmuch as he raised arguments in his Reply to Public Respondent's Comment which were not considered therein. More specifically, petitioner alleges that supervening events have transpired in Matanog, Maguindanao, where he and private respondent were mayoralty candidates in the elections of 1998, that warrant a reconsideration or modification of our Decision in this case.

After a careful perusal of the said Motion, however, this Court finds that petitioner failed to show compelling reasons to suspend the Rules insofar as the prohibition against second motions for reconsideration is concerned.

ACCORDINGLY, the Court Resolved to DENY the "Motion for Leave of Court to File the Herein Incorporated Second Motion for Reconsideration and/or to Modify the Decision due to Supervening Events with Prayer to Maintain the Status Quo". The alleged supervening event is forthwith REFERRED to the Commission on Elections for appropriate action. Pardo, J., took no part.
