FIRST DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 18 2000.

G.R. No. 140801 (Presidential Commission of Good Government, et al., vs. Hon. Aniano A. Desierto, et al.)

The Court Resolved to (a) NOTE the manifestation dated 25 August 2000 of public respondent Aniano Desierto, which he submitted in compliance with the resolution of 31 July 2000 ordering him and respondent Santiago Nuval to show cause why they should not be disciplinary dealt with or held in contempt for failure to file the Comment required in the resolution of 17 January 2000; and (b) SET ASIDE the resolution of 31 July 2000 insofar as public respondent Desierto is concerned considering that on 1 March 2000 he did file a Manifestation and Motion in Lieu of Comment, wherein he manifested that since "petitioner's complaint docketed as OMB-0-98-0403 was dismissed mainly on the ground of prescription, after due deliberation on the matter. [he was willing] to have the complaint subject matter of this case remanded to the Office of the Ombudsman for preliminary investigation."

Considering the aforementioned Manifestation and Motion in Lieu of Comment, the Court further Resolved to (a) GRANT the instant petition and SET ASIDE the assailed Resolutions of the Ombudsman of 25 June 1999 dismissing OMB No. 0-98-0403 entitled Presidential Commission on Good Governemnt vs. Panfilo Domingo and of 24 September 1999 denying the motion for the reconsideration; and (b) DIRECT public respondent Aniano Desierto and the Office of the Ombudsman to conduct preliminary investigation of said case OMB No. 0-98-0403 in light of the Court's decision of 25 October 1999 in G.R. No. 130140 (Presidential Ad Hoc Fact-Finding Committee on Behest Loans vs. Aniano Desierto).
