Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated AUG 29 2001.
A.M. No. 01-1-15-RTC(Re: Urgent Appeal/Petition for Immediate Suspension and Dismissal of Judge Emilio B. Legaspi, Regional Trial Court, Iloilo City, Branch 22.)
In a Resolution dated February 19, 2001, the Court RESOLVED to: a.] Dismiss the Urgent Application/Petition for Immediate Suspension and Dismissal of Judge Emilio B. Legaspi, Regional Trial Court, Iloilo City, Branch 22; and b.] Require complainant to show cause why he should not be cited in contempt of court for unduly wasting the court's time and resources by filing the complaint.
In view, however, of the gravity and seriousness of the charges imputed against the respondent judge, the Court deems it proper and more in keeping with the principle of fair play to give the contending parties an opportunity to argue the merits of their respective causes in a full-dress hearing.
ACCORDINGLY, the Court Resolves to:
1.] RECALL the Resolution dated February 19, 2001; and
2.] REFER this case to Associate Justice Delilah V. Magtolis of the Court of Appeals for investigation, report and recommendation within ninety (90) days from receipt hereof.
