Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated AUG 14 2001.
G.R. Nos. 139698-726(People of the Philippines vs. Wilfredo D. Matugas.)
This is a motion for extension for thirty (30) days within which to file the appellee's brief filed by the Office of the Solicitor General (OSG). The motion is actually the fifth filed by the OSG. In the resolution of July 17, 2001, the Court granted the OSG an extension of thirty (30) days or until July 13, 2001 within which to file the appellee's brief with warning that no further extension will be granted, considering that the extension granted would have given the OSG a total of 160 days for filing the appellee's brief. Except for the stereotypical excuse that the OSG has other pressing work, no other reason is given why, despite the time allowed it and the warning that no further extension would be granted, the present motion is being filed. For this reason, the Court RESOLVED to GRANT the Office of the Solicitor General a fifth, and definitely last, extension of 30 days, to be counted from the expiration of the last extension, or until August 12, 2001, within which to file the appellee's brief, otherwise this case will be considered submitted for decision without such brief. Assistant Solicitor General Mariano Martinez and Solicitor Violeta Ticzon are hereby required to SHOW CAUSE why they should not be disciplinarily dealt with for failure to comply with this Court's resolution of July 17, 2001 giving them an ultimatum until July 13, 2001 within which to file the appellee's brief.
