RE: PROPOSED RULES ON MANDATORY CONTINUING LEGAL EDUCATION

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated DEC 11 2001.
B.M. No. 850 (Re: Proposed Rules on Mandatory Continuing Legal Education.)
The Letter dated 3 December 2001 of Mme. Justice Carolina Gri�o-Aquino, Chairman, MCLE Committee, re errors in the MCLE Implementing Regulations as published in The Manila Bulletin on 15 November 2001 and The Philippine Daily Inquirer on 16 November 2001, is NOTED.
Clerk of Court Luzviminda D. Puno is hereby DIRECTED to cause the publications of the following corrections in a newspaper of general circulation:
1. The period of submission of an application for approval of a CLE activity or program as provided in paragraph (f) Section 7, and paragraph (a) Section 8, should be forty-five (45) days - not 90 days - prior to the presentation of the activity.
2. Section 14 on Reinstatement should be renumbered as Section 13 for it follows Section 12.
3. Section 15 on reporting Period after Reinstatement should be renumbered as Section 14.
4. Section 16 on Schedule of Fees should be renumbered as Section 15.
5. Paragraphs (a) and (b) of Section 15 should read as follows:
a. Fee to accompany application for accreditation as CLE provider....P2,000.00 (P1,000.00 only for a government educational institution or office or an IBP chapter)
b. Fee to accompany application for approval of CLE activity....P100.00 per expected attendee, subject to verification of official attendance record submitted by the provider.(A government educational institution, office, or IBP chapter accredited as MCLE provider, shall pay a nominal fee of P500.00 per application for approval of MCLE activity/program.)
6. The title of MCLE Form No. 01 should be "Application for Accreditation as MCLE Provider".
7. The footnote in MCLE Form No. 02 should read as follows:
"Six (6) copies of this application and the attachments thereto should be submitted to the MCLE Committee at least 45 days before the presentation of the scheduled activity/program."
8. The first paragraph of MCLE Form No. 02-A, Certificate of Approval of Program/Activity, should read as follows:
"THIS IS TO CERTIFY that________________________
Name of Program/Activity
scheduled on ____________to be held at _______________
Venue
has been approved for MCLE purposes subject to
the observance of all undertakings and reportorial
requirements by the Provider with office address at
_____________________ which will provide the
following program/activity."
9. MCLE Form No. 02-B (MCLE Attendance Card) should follow MCLE Form No. 02-A, thus:

10. The first paragraph of MCLE Form No. 07 should read as follows:
"The Committee, on the basis of the report of the IBP
Committee on Bar Discipline on Attorney

he/she be suspended/delisted/readmitted as a member
of the Integrated Bar of the Philippines."
Puno and Buena, JJ., are abroad on official business.
