Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 6 2001.
G.R. No. 134604(People of the Philippines vs. Ernesto Hugo, et al.)
Until this time, Atty.
Arturo B. Cefra, counsel for accused-appellants Ernest Hugo and Rudy Hugo, has
not filed the Appellant's Brief for his clients.In the resolution of 4 April 2000, Atty. Cefra was required to show
cause why no disciplinary action should be taken against him for his failure to
file the Appellants' Brief for Ernesto and Rudy Hugo within the requested
extended period and to file said Brief within ten (10) days from notice of the
Resolution.Atty. Cefra failed to file
the Brief.Accordingly, in the
Resolution of 5 September 2000 the Court imposed upon him a fine of Two
Thousand Pesos (P2,000), payable within five (5) days from notice, or
imprisonment of five (5) days if he would fail to pay it within said period,
and to comply with the filing of the brief (erroneously indicated as reply
brief) within ten (10) days.
Atty. Cefra paid the fine
of Two Thousand Pesos (P2,000), on 18 October 2000, but again failed to
file a Brief.
For his failure to file
the required Appellant's Brief for his clients in this case in deliberate
defiance of the Resolutions of 4 April 2000 and 5 September 2000, the Court
hereby RESOLVES to impose on Atty. Arturo B. Cefra another Fine of Five
Thousand Pesos (P5,000), payable within five (5) days from receipt
hereof, or for him to suffer imprisonment for ten (10) days if he fails to pay
said fine within the given period.He
is further DIRECTED to file the Appellant's Brief for accused-appellants
Ernesto Hugo and Rudy Hugo within ten (10) days from notice hereof, with a
warning that should he still fail to do so, he shall be arrested and detained
at the detention cell of the National Bureau of Investigation (NBI), NBI
Building, Taft, Avenue, Manila, until he shall have filed said Brief.
