[G.R. No. 135396.February 12, 2001]
PEOPLE OF PHILIPPINES vs. EVANGELISTA
SECOND DIVISION
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated FEB 12 2001.
G.R. No. 135396(The People of the Philippines vs. Teodoro Evangelista y de los Reyes.)
On June 30, 1999, the Court ordered the Clerk of Court of Branch 118 of the Regional Trial Court of Pasig City to require Stenographer Elizabeth Panique to certify the correctness of the transcripts of stenographic notes taken by her on August 11 and 24, 1994.
In their letter, dated August 18, 2000, Branch Clerk of Court Ma. Teresa D.M. Ortiz and Judge Nelson B. Bayot stated that Stenographer Panique is no longer in the service. For this reason, the Court required the parties themselves to state whether the said transcripts of stenographic notes, dated August 11 and 24, 1994, are correct (Resolution of October 25, 2000).
In his Manifestation and Motion, dated December 22, 2000, the Solicitor General informs the Court that he cannot comply with the aforesaid resolution because he does not have copies of the said transcripts of stenographic notes. He prays that appellant's counsel be directed to furnish him copies of said transcripts and that the period to file the required manifestation as to the correctness of the transcripts be allowed to commence from the date of his receipt of the same.
In his Reply to the Solicitor General's Manifestation and Motion, counsel for accused-appellant Atty. Rodante D. Marcoleta states that he is not in a position either to state whether the transcripts of stenographic notes in question are correct because another lawyer, Atty. Narzal Millares, represented accused-appellant during trial.
Considering the foregoing, the Court RESOLVED to require the Chief of the Judicial Records Office to furnish the Solicitor General and Atty. Narzal Millares with copies of the transcripts of stenographic notes of the hearings on August 11 and 24, 1994. The latter are hereby required to inform the Court within ten (10) days from their receipt thereof whether the said transcripts of stenographic notes are correct.
Very truly yours,
(Sgd.) TOMASITA M. DRIS
Clerk of Court
