Quoted hereunder, for your information, is a resolution of this Court dated JAN 17 2001.
A.C. No. 5394 (Engr. Rizalino Fernandez vs. Atty. Reynaldo Novero, Jr.)
This is a letter-complaint, dated October 15, 1996, filed by Engr. Rizalino Fernandez seeking the disbarment of Atty. Reynaldo Novero, Jr. for patent and gross neglect of professional duty in representing complainant in a case (Civil Case No. 7500 entitled "Engr. Rizalino Fernandez, et al. v. Bacolod City Water District") filed before the Regional Trial Court, Branch 49, Bacolod City. After respondent Atty. Reynaldo Novero, Jr. had filed his comment, the Court, in its resolution of October 13, 1997, referred the case to the Office of Bar Confidant for evaluation, report, and recommendation within sixty (60) days from notice. Up to this date, however, no report has been rendered. In a communication, dated January 11, 2001, Atty. Ma. Cristina B. Layusa, Acting Chief, Office of the Bar Confidant, explains that the lawyer assigned to this case resigned and the records of this case were misplaced. She asked that she be given thirty (30) days within which to submit the required report and recommendation.
Considering the explanation given and so as not to delay further the disposition of this case, the Office of the Bar Confidant is hereby given thirty (30) days from notice within which to submit the required report and recommendation, otherwise disciplinary action will be taken against the responsible parties or employees.
