REQUEST OF GOV. FERDINAND R. MARCOS JR.

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated MAR 27 2001.

A.M. No. 98-9-285-RTC( Re: Request of Gov. Ferdinand R. Marcos, Jr. that all RTC Judges of Ilocos Norte be designated as Assisting Judges of RTC-Br. 19, Bangui, Ilocos Norte.)

In the Resolution of the Court En Banc dated 29 September 1998 all RTC judges of Ilocos Norte were designated as assisting judges of RTC-Br. 19, Bangui, Ilocos Norte, to decide all the inherited cases that were submitted for decision to Judge Rodolfo U. Manzano but which were left undecided at the time of his retirement. In compliance with the Court's Resolution Executive Judge Perla Querubin, RTC-Br. 11, Laoag City, conducted a raffle and distributed the inherited cases among the RTC judges of Ilocos Norte. Criminal Cases Nos. 1002, 1003, 1005, 1028, 689 and 738 were assigned to Judge Alejandrino C. Cabebe.

On 21 August 2000 Judge Cabebe issued an Order in Crim. Cases Nos. 1002, 1003, 1005 and 1028 stating that it was necessary to reopen the aforementioned cases to organize all the records. However, he could not conduct such an action since his authority was only limited to deciding the cases.

In the First Indorsement, dated 31 August 2000, Executive Judge Jose C. Pilar, Branch 19, Bangui, Ilocos Norte, requested for instruction and guidance concerning the 21 August 2000 Order of Judge Cabebe.

On 23 January 2001 the Court noted the First Indorsement of Judge Pilar and referred the matter to the. Office of the Court Administrator for evaluation, report and recommendation.

In her memorandum, dated 20 February 2001, Acting Court Administrator Zenaida N. Elepa�o requested that the Agenda Report dated 20 November 2000 be considered as compliance with the Resolution of 23 January 2001. In the aforesaid Agenda Report, the Office of the Court Administrator recommended that the Order dated 21 August 2000 of Judge Cabebe, RTC-Br. 18, Batac, Ilocos Norte, in Criminal Cases Nos. 1002, 1003, 1005 and 1028 entitled People v. Mandy Barriga be noted; and Judge Pilar, RTC-Br. 19, Ilocos Norte, be directed to take the appropriate action on such cases:

ACCORDINGLY, the Court Resolves to NOTE the Memorandum of Acting Court Administrator Zenaida N. Elepa�o and to ADOPT the recommendation in the Agenda Report of 20 November 2000. Executive Judge Jose C. Pilar, RTC-Br. 19, Bangui, Ilocos Norte, is DIRECTED to take immediately the necessary action with full authority to organize and complete the records in Crim. Cases Nos. 1002, 1003, 1005 and 1028 and to decide them accordingly with deliberate dispatch. Puno, J., is abroad on official business.
