REQUEST OF JUDGE BALINDONG FOR TEMPORARY DETAIL TO RTC BR. 11.

SECOND DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated OCT 8 2001.

A.M. No. 01-5-271-RTC(Request of Judge Rasad G. Balindong for temporary detail to Regional Trial Court, Branch 11, Malabang, Lanao Del Sur.)

For resolution is the letter dated 22 August 2001 of RTC Judge lsmael G. Bagundang, Al Haj, Branch 15, Cotabato City, by way of compliance with the Resolution dated 13 August 2001, which required him to explain his non-compliance with Administrative Order No. 61-97 dated 25 June 1997 under pain of administrative sanction. In his letter, Judge Bagundang states that immediately upon the receipt of the Order directing him to help in the disposition of the cases left pending by the resignation of Judge Romeo S. Sucaldito, RTC Branch 20, Tacurong City, Sultan Kudarat, he complied therewith and has decided more than 50 cases. Attached to said letter is a Certification issued by the Court Legal Researcher II and OIC-Clerk of Court Pelagio C. Hilario, Jr. of RTC Branch 20, Tacurong City, enumerating therein the 56 cases decided by Judge Bagundang and promulgated on various dates. Judge Bagundang also explains that after the assumption of Judge Francisco G. Palmones as Presiding Judge, RTC Branch 20, he stopped rendering decisions in cases pending in said Branch because of his impression that since Judge Palmones was already appointed to that sala, he no longer had the authority to decide cases pending therein.

WHEREFORE, the Court RESOLVES to ACCEPT AS SATISFACTORY the letter/explanation dated August 22, 2001, of Judge Ismael G. Bagundang, Al Haj.

SO ORDERED.
