REPORT ON THE JUDICIAL AUDIT AND PHYSICAL INVENTORY OF CASES CONDUCTED IN MTC BR 1 TO 4

FIRST DIVISION

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated SEPT 5 2001.

A.M. No. 00-11-248-MTC(RE: Report On The Judicial Audit And Physical Inventory Of Cases Conducted In The Municipal Trial Court, Branches 1 to 4, Tuguegarao, Cagayan.)

On July 26 to 28, 2000, the Office of the Court Administrator conducted a judicial audit and physical inventory of cases in Branches 1 to 4, Tuguegarao, Cagayan, pursuant to Travel Order No. 30-00, dated July 13, 2000.

The report 1 Dated October 30, 2000.by the judicial audit and inventory team states:

MUNICIPAL TRIAL COURT, BRANCH 4, TUGUEGARAO, CAGAYAN

Presided over by Judge Jimmy R. Butacan, this Court had, as of audit date, a total caseload of 376 cases (340 criminal cases and 36 civil cases) based on the records actually presented and examined by the team.

Judge Butacan was also the Acting Presiding Judge of the Municipal Circuit Trial Court, Solana-Enrile, Cagayan. He conducted trial sessions on Mondays at the Municipality of Enrile and on Fridays at the Municipality of Solana.

As to cases pending trial, the general observation is that cases were being heard at a normal pace. The resetting of cases, except for a few, was for a period not longer than that required by the rules on adjournments of trial.

With regard to the management of the court records, the team observed that the records were not well kept and managed. There were missing records that were produced only after diligent search. The records of active cases were mixed with those already disposed of or dismissed. The court maintained separate docket books for civil and criminal cases but the entries thereon were not updated. Warrants of arrest and summonses were promptly issued but the same were returned unserved. As of audit, the Court had not submitted the Docket Inventory of Cases for the 2nd Semester (July -December, 1999), the 1st Semester (January-June, 2000) and the Monthly Report of Cases for June, 2000.

It would appear from the findings of the audit team that the person responsible for the non-submission of the Semestral Docket Inventory of Cases and Monthly Report of Cases was Ms. Rolanda R. Cabulisan, the Clerk of Court, Municipal Trial Court, Branch 4, Tuguegarao, Cagayan.

In VIEW OF THE FOREGOING, the Court resolves to:

(a) SEVERELY REPRIMAND Ms. Yolanda R. Cabulisan, Clerk of Court, Municipal Trial Court, Branch 4, Tuguegarao, Cagayan for failure to submit the Semestral Docket Inventory of Cases for the Second Semester of Year 1999 and 1st Semester of Year 2000 and the Monthly Report of Cases for the Month of June 2000;

(b) REQUIRE her to submit the same within thirty (30) days from notice;

(c) REQUIRE her to update the entries in the docket books; and

(d) DIRECT her to:

1) IMMEDIATELY SET for hearing those cases which have no proceedings or settings; and

2) ATTACH the Certificates of Arraignment to the records of criminal cases.
