Quoted hereunder ,for your information, is a resolution of the Court En Banc SEPT 18 2001.

G.R. No. 139249(Jose Andre Ricardo V. Garcia vs. Civil Service Commission.)

This petition for review seeks the setting aside of the decision of the Court of Appeals dated October 28, 1998, affirming en toto the twin resolutions numbered 973267 and 974506 of the Civil Service Commission dated August 22, 1997 and November 26, 1997, respectively.

CSC Resolution No. 973267 decreed thus:

����������� "WHEREFORE, Jose Andre Ricardo V. Garcia is hereby found guilty of dishonesty. However, since he is no longer considered in the government service with the privatization of the PNB, the penalty of dismissal is deemed implemented. Garcia, however, is hereby perpetually disqualified from re-entering/joining the government service and from taking government examinations in the future.

����������� "Let a copy of this resolution be furnished the Office of the Ombudsman for appropriate criminal action."

CSC Resolution 974506, on the other hand, denied petitioner's motion for reconsideration of the aforecited resolution.

Considering that petitioner's dismissal from the government service was deemed implemented with the privatization of the Philippine National Bank, the Court resolved to dismiss the case for having become moot and academic.
