RE:PROBLEM OF DELAYS IN CASES BEFORE THE SANDIGANBAYAN

Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 29 2002.
A.M. No. 00-8-05-SC (Re:Problem of Delays in Cases Before the Sandiganbayan- Letter, dated 04 January 2002 of Associate Justice Anacleto D. Badoy, Jr. praying for clarification of the resolution of 28 November 2001.)
"In this letter, associate Justice Badoy poses the following questions: First , whether or not during the indefinite period of his leave of absence, he may fill up the positions for additional staff approved by the Chief Justice; and Second , whether or not the Resolution promulgated on 28 November 2001 in A. M. No. 00-8-05-SC (Re: Problem Delays in Cases Before the Sandiganbayan) apply to him during the indefinite period of his leave of absence."
We resolve thus:
(1)������ Associate Justice Badoy, Jr. need not fill up the positions for additional staff as he has been relieved of his duties with respect to the plunder case against former President Joseph Ejercito Estrada. Thus, additional staff members are no longer necessary.
(2)������ The resolution promulgated on 28 November 2001 on A.M. No. 00-8-05-SC which requires that cases be decided within three (3) months from submissions for decision apply to Justice Badoy, Jr. despite the fact that he is on an indefinite leave of absence will not suspend the running of the period within which to decide the cases.
The Court further Resolved to NOTE the:
(a)������ Compliance dated 3 December 2001 submitted by Francis E. Garchitorena;
(b) Letter dated 11 October 2001 of Presiding Justice Francis E. Garchitorena, re request of Justice Anacleto D. Badoy, Jr. for additional personnel, charging the latter with incompetence, etc.;
(c)������� Comment dated 3 January 2002 of Justice Badoy on the aforesaid letter of Presiding Justice Garchitorena;
(d)������ Urgent Motion for Extension of ten (10) days from 14 December 2001 within to file Clarification and Motion for Reconsideration of the resolution of 28 November 2001, dated 14 December 2001 filed by Presiding Justice Francis E. Garchitorena;
(e)������ Compliance with the resolution of 28 November 2001 with specific reference to the adoption and submission of internal rules of the Sandiganbayan, dated 23 November 2002 filed by Acting Presiding Justice Minita Chico-Nazario; and
(f)�������� aforesaid Revised Internal Rules of the Sandiganbayan.
