Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JAN 22 2002.
G.R. No. 133888 (People of the Philippines vs. Alfredo Nardo y Rosales.)
On March 1, 2001, the Court affirmed the conviction of accused-appellant for incestuous rape and the imposition on him of the death penalty. Accused-appellant filed a motion for reconsideration praying that the Court recommend to the President the commutation of his sentence. He cites the letters sent to him by his daughter, the victim herein, expressing her love for him and absolving him of the rape.
ACCORDINGLY, in accordance with Section 25 of Republic Act No. 7659, amending Article 83 of the Revised Penal Code, let the records of this case be REFERRED to the Office of the President for possible exercise of executive clemency or pardoning power. The two letters of Lorielyn Nardo, accused-appellant's daughter, to the Public Attorney dated July 13, 1999 and April 17, 2000 shall be attached to and from part of the records.
