CRUZ vs. JUDGE YANEZA
EN BANC
Gentlemen:
Quoted hereunder, for your information, is a resolution of this Court dated JUL 9 2002.
A.M. No. MTJ-99-1175 [Formerly OCA IPI No. 98-564-MTJ](Victorino Cruz vs. Judge Reynold Q . Yaneza, Branch 54, Navotas, Metro Manila.)
In our Decision of 9 March 1999 we dismissed from the service respondent Judge Reynold Q. Yaneza, MeTC-Br. 54, Navotas, Metro Manila, for approving bail bonds and issuing release orders in violation of Rule 114 of the Rules of Court.
On 12 April 1999 a certain Napoleon Z. Villamor furnished the Office of the Ombudsman a copy of the 9 March 1999 Decision and prayed that an investigation be conducted to determine the possible criminal culpability of Judge Yaneza on the same acts that caused his ouster. On 28 February 2002 Director Gerardo B. Lantoria Jr. of the Fact-Finding and Intelligence Bureau, Office of the Ombudsman, wrote this Court requesting a certified true copy of the 9 March 1999 Decision including all the evidence gathered relative thereto.
The Court grants the request of the Office of the Ombudsman. To expedite matters, however, the Court suggests that a Liaison Officer of the Ombudsman be sent to the Judicial Records Office of the Court to secure a certified true copy of the 9 March 1999 Decision in A.M. No. MTJ-99-1175, and to photocopy the needed records, subject to the direct supervision and control of the Clerk of Court of this Court.
Very truly yours,
