Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated APR 29 2003.

G.R. No. 155832(Republic of the Philippines vs. Sandiganbayan (Fourth Division) and Imelda R. Marcos.)

Acting on the "Urgent Motion (to enforce the Supreme Court's Temporary Restraining Order)," dated January 28, 2003, filed by petitioner through the Office of the Solicitor General and the Presidential Commission on Good Government, and the "Comment and/or Opposition" thereon, dated 22 March 2003, filed by Atty. Robert Sison, collaborating counsel for private respondent, the Court RESOLVES (1) to require private respondent and her aforesaid counsel to comply with this Court's Temporary Restraining Order dated 3 December 2002 by surrendering possession and control of the subject premises to herein petitioner immediately upon receipt of this Resolution; and (2) upon their failure or refusal to do so, to direct the Sheriff of the Sandiganbayan and the Director-General of the Philippine National Police to enforce said Resolution by using all legal means necessary to remove or eject any person or persons representing private respondent from the subject property.

The Court NOTES that the arguments raised by private respondent and/or her counsel in the "Comment and/or Opposition" are merely justifications why the TRO should not be issued, not why it should be disobeyed.Since the TRO has been actually issued by the Court, the rule of law requires that all - especially the parties - must obey it.While they have a right to argue against it, or to ask even for its lifting, the parties are required, in the meantime, to follow it in all good faith.
