JUAREZ, SR. vs. BERCADES

SECOND DIVISION

Gentlemen:

Quoted hereunder, for your information is a resolution of this Court dated DEC 10 2003.

A.M. No. OCA IPI 99-753-MTJ (Alfredo B. Juarez, Sr. vs. Judge Renato B. Bercades, MCTC, Magdalena-Liliw-Majayjay, Laguna.)

This refers to complainant's (1) Letter to the Court Administrator dated September 22, 2003 expressing hope that his resolute request for justice, which was subsequently endorsed to the Office of the Ombudsman, shall soon merit an objective conclusion, and (2) Motion for Reconsideration of the Resolution of September 8, 2003, which noted without action the administrative complaint against the Division Clerk of Court of this Court, and further praying that said resolution be set aside and that Judge Renato B. Bercades be held administratively liable for two counts of gross ignorance of the law, repeated usurpation of jurisdiction, abuse of authority, propensity in pillorying the innocent in furtherance of Judge Bercades' ulterior motives to frustrate complainant's quest for truth and justice. It appearing from the records that:

(a) In the Resolution of July 30, 2003, complainant's administrative complaint against the Division Clerk of Court was dismissed for utter lack of merit and complainant was informed that "the resolutions subject of his administrative complaint which are signed by the Division Clerk of Court are merely reproductions of the actions taken by the Court after deliberations as reflected in the minutes of its proceedings;" and

(b) In the Resolution of November 25, 2002, complainant's administrative complaint against Judge Bercades was already dismissed for lack of merit and he was advised to refrain from filing similar complaints in the future, and that in the Resolution of March 5, 2003, his motion for reconsideration was similarly denied for lack of merit.

the administrative complaints against the Division Clerk of Court and Judge Bercades have been duly passed upon by the Court, NO FURTHER PLEADINGS respecting these matters shall be entertained. Alfredo B. Juarez, Sr. is WARNED that further pleadings shall be expunged from the records and may subject him to contempt of court.
