UPSI PROPERTY HOLDINGS, INC. vs. DIESEL CONSTRUCTION CO., et al.

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated 15 JAN 2003.

G.R. No. 154937(UPSI Property Holdings, Inc., petitioner, vs. Diesel Construction Co., Inc., and FGU Insurance Corporation, respondents.)

Records show that on August 27, 2002, petitioner, through its former counsel, received a copy of the Court of Appeals Resolution dated August 21, 2002 denying its motion for reconsideration of the assailed Decision. Thus, petitioner had until September 11, 2002 to file its petition for review on certiorari with this Court.

On September 11, 2002, petitioner received from its former counsel a Motion to Withdraw Appearance. On the same date, petitioner, through its new counsel, filed with this Court the following: (a) Ex parte Manifestation with Motion to Admit Motion for Extension of Time to File Petition; and (b) Motion for Extension of Time to File Petition (from September 26 to October 26, 2002) with Entry of Appearance of New Counsel for Petitioner. On November 11, 2002, this Court granted both motions.

In a Resolution dated November 13, 2002, this Court resolved to:

(a)� Note respondent's Opposition to the Motion for Extension of Time to File Petition; and

(b)� Deny petitioner's Urgent Motion for Extension of Time to File a Petition for Review on Certiorari from September 26 to October 26, 2002 considering that a second motion for extension of time to file a petition for review on certiorari is prohibited. We have observed lately, however, that this motion is not a second motion for extension. This is the same and first motion for extension filed on September 11, 2002.

It appearing that petitioner's Motion for Extension of Time to File a Petition for Review on Certiorari is actually not a second motion, our Resolution dated November 13, 2002 denying petitioner's Motion for Extension of Time to File a Petition for Review on Certiorari is SET ASIDE.

Acting upon petitioner's Petition for Review on Certiorari filed seasonably on October 25, 2002, this Court resolved to require respondent to file its comment thereon within ten (10) days from notice.
