MARBAS-VIZCARA vs. SORIANO

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUN 25 2003.

A.M. No. P-01-1491(Judge Eleanor Teodora Marbas-Vizcara vs. Princesito Soriano.)

On March 28, 2003, we found Princesito Soriano, process server, Municipal Trial Court, Nueva Ecija guilty of gross discourtesy and suspended him for six (6) months without pay.

In a letter to the Office of the Chief Justice dated April 9, 2003, Soriano seeks reinstatement to his present position for humanitarian reason considering that he has been under suspension for nineteen (19) months already. He also asks the Court that the meted penalty be charged from his preventive suspension which started on September 15, 2001.

In Re: Initial Reports on the Grenade Incident that occurred at about 6:40 a.m. on December 6, 1999 Submitted by DCAs Zenaida Elepa�o and Reynaldo Suarez, * we allowed the reinstatement of Atty. Marina Ching who was meted a one (1) year suspension for disgraceful conduct and immorality to be reinstated to her position as Attorney VI after she was indefinitely suspended for a period of more than one year.

Therefore, Soriano, who had been under preventive suspension for nineteen (19) months, which is beyond the six months' suspension without pay imposed on him, may now be reinstated.

IN VIEW OF THE FOREGOING, Princesito Soriano is considered to have fully served his suspension and is ordered REINSTATED to his position as process server of Municipal Trial Court, Nueva Ecija. This Resolution shall be immediately executory upon service of a copy to Princesito Soriano.
