Quoted hereunder, for your information, is a resolution of this
Court dated
A.M. No. P-02-1656 (Norma A. Defontorum vs. Floro O. Defontorum.)
Considering that an affidavit of desistance by a complainant does not divest the Supreme Court of its jurisdiction to investigate and ascertain the truth of the matter alleged in a complaint against a court personnel (Baikong Akang Camsa vs. Judge Aurelio D. Rendon , A.M. No. MTJ-02-1395, March 28, 2003), the Court resolves to REFER BACK the instant administrative matter to Executive Judge Jules A. Mejia, regional Trial Court, Alaminos City, Pangasinan, Branch 54, for a more thorough investigation on the alleged immorality of respondent for living with a woman of ill repute under scandalous circumstances.The Executive Judge shall submit his report and recommendation within sixty (60) days from receipt of the record.
