PEOPLE vs. CARA

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 9 2004.

G.R. No. 147273 (People of the Philippines vs. Juditho Cara, et al.; Joselito Lacuna, Nestor Mananquil, Jr., Rey Yap and Roy Yap, accused-appellants.)

Considering the letter dated October 27, 2003 of Marcelo M. Manalo, Police Senior Superintendent, Camp Commander, PNP-NCRPO, Camp Bagong Diwa, Bicutan, Taguig, Metro Manila, requesting for the transfer of prisoner Juditho Cara from his present detention at the Custodial Office of the PNP-NCRPO to the National Bilibid Prison or any other jail at the discretion of the Court, and it appearing that former Presiding Judge Rodolfo A. Ponferrada already issued an Order dated August 12, 2002 granting the motion dated May 27, 2002 of the Police Superintendent Carlito B. Abogado for the transfer of Juditho Caro from Camp Bagong Diwa to the National Bilibid Prison, the Court resolves to REQUIRE the presiding judge of Regional Trial Court of Manila, Branch 41, to COMMENT on the letter of Police senior Superintendent Marcelo M. Manalo within ten (10) days from notice.

The Division Clerk of Court is DIRECTED to furnish the presiding judge of the Regional Trial Court of Manila, Branch 41, with a copy of said letter.
