RE: TRANSFER OF CRIMINAL CASE NO. 19693

Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated FEB 16 2004.

A.M. No. 03-12-709-RTC (Transfer Of Criminal Case No. 19693 From The RTC-Br. 14, Zamboanga City To Muntinlupa City, Involving Insular Prisoner Diego Buhain.)

Acting on the letter dated September 25, 2003 of Judge Ernesto R. Gutierrez, Regional Trial Court (RTC), Branch 14, Zamboanga City, requesting that Criminal Case No. 19693, entitled "People of the Philippines vs. Diego Buhain," for grave threats pending before his sala, be transferred to any RTC in Muntinlupa City in view of the impending transfer of accused Diego Buhain to the New Bilibid Prison in Muntinlupa City pending in review of the judgment rendered by Judge Jesus C. Carbon Jr., RTC, Branch 16, Zamboanga City, in Criminal Case No. 15757 convicting him for kidnapping with homicide and sentencing him to suffer the death penalty, the Court resolves to:

1)� GRANT the request of Judge Gutierrez for the transfer of Criminal Case No. 19693 to the RTC of Muntinlupa City;

2)� DIRECT Judge Gutierrez to immediately FORWARD the records of the case to Judge Juanita Tomas Guerrero, Executive Judge of the RTC, Muntinlupa City;

3)� DIRECT Judge Guerrero to RAFFLE the case among the judges of the different branches of RTC, Muntinlupa City and;

4)� DIRECT the judge to whom Criminal Case No. 19693 shall be raffled to: (a) PROCEED with dispatch with the trial and hearing of the Case within the premises of the New Bilibid Prison, taking along with him/her at least two (2) of his/her personnel who shall be entitled to reimbursement for transportation expenses, and (b) RENDER JUDGEMENT and PROMULGATE the same also within the premises of the New Bilibid Prison.
