Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JUL 20 2004.

G.R. Nos. 96027-28 (Brig. Gen. Luther A. Custodio, et al. vs. Sandiganbayan, et al.)

The Court Resolved to NOTE the separate Indorsements dated 28 June 2004 and 29 June 2004 of Chief Justice Hilario G. Davide, Jr., referring the letter-petitions dated 21 June 2004 of Romeo M. Bautista, et al., and Arnulfo Artates, et al., respectively.

Acting on the aforesaid letter-petitions, the Court Resolved to DENY the prayer therein for the release of the detained military personnel in Criminal Cases Nos. 10010 and 10011, entitled People of the Philippines vs. Brig. Gen. Luther Custodio, et al., for lack of merit.
