Gentlemen:
Quoted hereunder, for your information, is a resolution of this
Court dated
G.R. Nos. 147238-40 (People of the Philippines vs. Maximo Javier.)
Notwithstanding the directive of the Court in the Resolution of September 10, 2003 requiring Atty. Salvador B. Britanico, counsel for accused-appellant, to show cause why he should not be held in contempt for his failure to file reply brief, the reiteration of said directive in the Resolution of October 22, 2003, and the imposition of a fine of P1.000.00 in the Resolution of January 12, 2004 another fine of P2,000.00 in the Resolution of February 18, 2004 and an additional fine of P4,000.00 in the Resolution of February 23, 2004 for his continued non-compliance, and considering that Atty. Britanico merely paid on March 30, 2004 the fine of P7,000.00 imposed by this Court but up to this very late date, has not filed the required reply brief nor explained the reasons for its non-submission, the Court Resolves to give Atty. Britanico a FINAL NON-EXTENDIBLE period of ten (10) days TO FILE THE REPLY BRIEF FOR ACCUSED-APPELLANT AND TO EXPLAIN WHY HE FAILED TO FILE SAID BRIEF, with STERN WARNING that should he still fail to do so, he shall be ordered arrested and detained until he complies with the same.
