Quoted hereunder, for your information, is a resolution of this
Court dated
Adm. Matter No. P-04-1765 (Judge Felipe G. Banzon vs. Ruby B, Hechanova, Court Stenographer III, RTC, Br. 69, Silay City.)
R E S O L U T I O N
Before the Court is the letter dated March 16, 2004 of respondent stenographer seeking reconsideration of our Resolution dated January 26, 2004 directing the National Bureau of Investigation to locate, arrest, and detain her at the Silay City Jail until she shall have finished transcribing all the untranscribed stenographic notes; requiring respondent to complete and finish the transcription of her stenographic notes within forty-five (45) days from notice, and to submit them to the Branch Clerk of Court of Branch 69, Silay City; directing the withholding of respondent's salary or remuneration; and holding in abeyance the resolution of the administrative complaint until after this Court shall have received a certification from the Branch Clerk of Court that respondent has finished the transcription of all the stenographic notes.
Respondent stated in her letter that she has talked to Judge
Banzon to tell him that the transcripts of stenographic notes covered by the
administrative case he filed were already submitted to his office. She further
alleged that Judge Banzon told her that some of said cases had already been
decided or dismissed and in some civil cases, the testimonies she took were
retaken since the stenographic notes she took could no longer be located. She

The Court cannot countenance respondent's obstinate refusal to comply with the lawful orders of Judge Banzon for her to submit subject transcripts of stenographic notes.
However, for humanitarian reasons, the Court hereby RESOLVES to:
(a) REQUIRE respondent Ruby B. Hechanova to COMPLETE and FINISH the transcription of her stenographic notes taken on the dates and/or in the cases listed in Judge Banzon's letters as stated above within an inextendible period of ninety (90) days from notice and to SUBMIT them immediately to the Branch Clerk of Court of RTC, Branch 69, Silay City;
(b) REQUIRE respondent Ruby B. Hechanova to immediately submit to this Court and the Branch Clerk of Court of RTC, Branch 69, the date of the receipt of herein resolution.
(c) HOLD IN ABEYANCE for a period of ninety (90) days from receipt hereof the enforcement of the directive to the National Bureau of Investigation (NBI) to arrest and detain her, PROVIDED she COMPLETES, FINISHES, and SUBMITS to the Branch Clerk of Court of RTC, Branch 69, Silay City within said period all the transcripts of stenographic notes as indicated herein;
(d) DIRECT the Branch Clerk of Court of RTC, Branch 69, Silay City to certify to this Court at the end of the 90-day period given to respondent, whether respondent has complied with the directives of this Resolution;
(e) HOLD IN ABEYANCE the resolution of this administrative complaint until after this Court shall have received the required certification from the Branch Clerk of Court of RTC, Branch 69, Silay City.
(a) DIRECT THE IMMEDIATE SUSPENSION OF RESPONDENT WITHOUT PAY PENDING RESOLUTION OF THE ADMINISTRATIVE COMPLAINT.
