Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 11 2005 .

G.R. No. 138381 (Government Service Insurance System vs. Commission on Audit) and G.R. No. 141625 (Government Service Insurance System vs. Alfredo D. Pineda, et al.)

The Court Resolved to

(a) CONSIDER as SERVED the resolution dated 21 September 2004 addressed to Sanchez Mercado & Melchor Law Firm, counsel for movant-intervenor, which resolution was returned unserved with the notation on the letter-envelope moved-out;

(b) TREAT the Letter dated 9 December 2004 of Alfredo D. Pineda, President, GSIS Retirees' Association, Inc., as a MOTION FOR RECONSIDERATION of the resolution of 10 November 2004; and

(c) DENY WITH FINALITY the said motion for reconsideration, as the basic issues raised therein have been passed upon by this Court and no substantial arguments were presented to warrant the reversal of the questioned resolution.
