Gentlemen:

Quoted hereunder, for your information, is a resolution of this Court dated JAN 11 2005.

G.R. No. 153266 (Victoria C. Gutierrez, et al. vs. Department of Budget and Management, et al.) and

G.R. No. 159029 (August R. Nieves, et al. vs. Department of Budget and Management, et al.)

The Court Resolved to

(a) CONSIDER as SERVED the resolution dated 7 September 2004 addressed to Ms. Liza Magallanes, President, PEZA-BEPZ Retirees Association, which resolution was returned unserved with the notation on the letter-envelope unclaimed; and

(b) REQUIRE the original parties to COMMENT, within ten (10) days from notice hereof, on the following:

(i) Motion for Leave of Court to Intervene as Petitioner in G.R. No. 153266 dated 30 November 2004 filed by counsel for movants Kapisanan Ng Mga Manggagawa Sa Bureau of Agricultural Statistics (KMB), et al.; and

(ii) Motion for Leave of Court to Intervene as Petitioners-in-lntervention in G.R. No. 153266 dated 16 November 2004 filed by counsel for movants ALERT and Concerned Employees for Better SSS (ACCESS), et aI.
